Re:       Petition for Review of Decision Not to File Charges against Rev. Carl McCauley filed by Ronald F. Avery

Dear Rev. White,

Thank you for that prompt reply. Does your reply below mean that the "Designated Review Committee" of the Permanent Judicial Commission has already received their required "Response" from the Investigative Committee? I am wondering if I get to read this "Response" to be filed by the Investigative Committee. In civil court this is appropriate and provided for and I feel in ecclesiastical court this would be even more appropriate and be provided. I would be most interested to read how the Investigative Committee perceived of how they performed their duties.

Your short reply below implies that I will be notified when the "Designated Review Committee" completed their entire review and made their decision regarding the performance of the duties of the Investigative Committee and if they are going to appoint a new Investigative Committee or not.

This leads me to believe that I do not get to read this "response" document filed by the Investigative Committee. And if my feeling is correct, I do not see how the "Response to my Petition" is a "response" to me and my Petition for Review. Who would it be in response to if not me? Why would I not have an interest in this response?

So far I have not heard a single word uttered as to what anyone thinks about my “Accusation of Offense” or my “Petition for Review” and now I am beginning to think that I will never hear a word from anyone other than ‘hit the road.’

No one can say that I did not try to help my church avoid the ruthless power of the police state and I will not be responsible to God for what is to come from the tyranny now present with us.

Sincerely,

Ron Avery

Mr. Avery:

Thank you for your inquiry.

You will be informed in a timely manner when the designated review committee of the Permanent Judicial Commission has informed me of their decision.

Re:       Petition for Review of Decision Not to File Charges against Rev. Carl McCauley filed by Ronald F. Avery

Dear Rev. White,

I filed the Petition referenced above on March 27, 2009 and I understand that the Investigative Committee is to submit a written respond to my Petition. I also understand that a decision must be made by the Permanent Judicial Committee to appoint another Investigative Committee or to not file charges depending on their determination of whether, or not, the Investigative Committee performed their duties listed in D-10.0202. I also understand that the PJC has 90 days from the date of the filing of the Petition for Review to render its decision.

It is now the 48th day, over half of the time provided, since the filing of the petition and I was wondering when I would be able to read the response to be filed by the Investigative Committee. I was also wondering whether or not the Investigative Committee has in fact submitted their response in writing as of this date.

Please let me know the status of my Petition for Review.

Sincerely,

Ronald F. Avery
